1. Acceptance of Terms

By accessing or using the Memoriance website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. Memoriance reserves the right to update these terms at any time, and continued use of the platform constitutes acceptance of any changes.

2. Description of Service

Memoriance provides a platform for creating and hosting online memorial and tribute pages. Users can create memorial pages, upload photos, write biographies, and share these pages with family and friends. Some features may be available for free, while others may require a paid subscription.

3. User Accounts

To create a memorial page, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to update your information as needed. Memoriance reserves the right to suspend or terminate accounts that violate these terms.

4. User Content

You retain ownership of all content you upload to Memoriance, including photos, text, and other materials. By uploading content, you grant Memoriance a non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of operating and providing the service.

You are responsible for ensuring that your content does not violate any third-party rights, including copyright, trademark, or privacy rights. Memoriance reserves the right to remove content that violates these terms or is otherwise objectionable.

5. Acceptable Use

You agree not to use Memoriance to:

  • Upload content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
  • Impersonate any person or entity, or falsely represent your affiliation with a person or entity
  • Create memorial pages for living individuals without their consent
  • Use the service for commercial advertising or spam
  • Attempt to gain unauthorized access to other users' accounts or to Memoriance systems

6. Memorial Page Longevity

Memoriance is committed to preserving memorial pages for as long as reasonably possible. However, we cannot guarantee indefinite hosting. In the event that the service is discontinued, we will provide reasonable notice and the opportunity to download your content.

7. Privacy

Your use of Memoriance is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Limitation of Liability

Memoriance is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Memoriance shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the service, including but not limited to loss of data or content.

9. Termination

You may close your account at any time via your account settings or by contacting us. Upon deletion, your account and all associated memorial pages will be permanently removed. Memoriance reserves the right to suspend or terminate your access to the service at any time for violation of these terms or for any other reason, with or without notice.

10. Payments & Pricing

Memoriance offers a free plan and a one-time paid upgrade called Memoriance Premium, priced at €29 per memorial. This is a single payment — there is no subscription, no recurring charge, and no automatic renewal.

All payments are processed securely by Stripe. Memoriance does not store your payment card details. By completing a payment you agree to Stripe's consumer terms.

Premium features are activated on your memorial immediately after payment is confirmed. A receipt is sent automatically to the email address you provide at checkout. You can view your payment history in your account settings under Billing & Payments.

11. Right of Withdrawal & Refund Policy

EU consumers — right of withdrawal. If you are a consumer located in the European Union, you have the right to withdraw from a purchase within 14 days of the date of payment, without giving any reason, under EU Directive 2011/83/EU.

Waiver of the right of withdrawal. Because Memoriance Premium is a digital service that is made available and consumed immediately upon payment, we ask you to explicitly waive your right of withdrawal at the time of purchase. This waiver is presented as a checkbox before you confirm payment. If you tick that checkbox and complete payment, you acknowledge that the 14-day withdrawal period no longer applies to your purchase, in accordance with Article 16(m) of EU Directive 2011/83/EU.

If you did not waive the right of withdrawal (for example, if you purchased before this clause was in place), you may exercise your withdrawal right by contacting us within 14 days of purchase at support@memoriance.com with the subject line Refund request and your Stripe session ID (visible in your Billing & Payments page). Refunds are processed within 5–10 business days to the original payment method.

Outside the withdrawal window. After 14 days from the date of payment, or after you have waived the right of withdrawal, payments are non-refundable. We may consider exceptions at our sole discretion in cases of technical failure on our part.
